Legal specialist in market infrastructures (m/f)

Mission

The division which is part of the “Innovation, Payments, Market Infrastructures and Governance” department, is responsible for financial market infrastructures, in particular in the context of CSDR, EMIR and SFTR, for the coordination of ESMA related tasks, as well as for international and regulatory aspects related to market infrastructures. In the context of CSDR, the division is responsible for the authorisation of CSDs and the supervision of regulatory and reporting obligations on settlement discipline and internalised settlement. In the context of EMIR and SFTR, the division is responsible for the supervision of the regulatory and reporting obligations of non-financial counterparties. The division represents the CSSF within national and international groups covering financial market infrastructure topics.

Role & responsibilities

  • Analyse legal questions submitted to the division
  • Analyse legal questions/issues arising in the context of the issuance of securities and assist other CSSF departments in the area of post-trading
  • Provide legal support for the activities of the team in charge of monitoring compliance with EMIR and SFTR obligations by the entities concerned, including possible sanctions procedures
  • Provide legal support for activities related to the analysis of CSD authorisation files
  • Contribute to the resolution of all legal issues submitted to the division, in particular relating to securities and financial instruments, notably as regards their issuance by CSDs and the settlement of transactions
  • Contribute to the execution of the division’s tasks in terms of ESMA Coordination
  • Ensure the monitoring of developments in national and international regulations on market infrastructures, derivatives and securities financing transactions and contributing to their adoption at national level
  • Liaison and coordination with other relevant CSSF departments, national competent authorities of other countries and European authorities
  • Draft reports and analyses on legal issues and topics for which the division is responsible
  • Analyse interpretational queries on the practical implementation of regulations on market infrastructures, in particular in the area of CSDR and securities issuance

Your profile

  • University degree (Bac +4/+5) in law
  • For applicants with a legal background, the possession of the certificate of complementary training in Luxembourg law (CCDL) and the end of judicial training examination is considered as an advantage
  • A first work experience in a renowned local law firm or in the legal service of a reputable professional of the financial sector
  • Good knowledge of the legal (company law, business law) and regulatory framework (law on the financial sector, laws relating to CSDR/EMIR/SFTR, law on payment services, European directives and regulations, CSSF regulations and circulars)
  • Proficiency in written and spoken French and English; German and / or Luxemburgish will be considered as an advantage

The successful candidate (m/f) will be hired as public employee (“employé de l’Etat”) under a permanent contract. If the candidate meets the required conditions, s/he will be asked to apply for admission to the status of civil servant (“fonctionnaire de l’Etat”).

Prior to the conclusion of the contract, the candidate must submit an extract from the criminal record (bulletin n°3), dated less than 2 months, in order to prove their conduct and integrity.
