Investment Fund Legal Specialist (m/f)

Mission

The SPII Prudential Supervision division, part of the UCI Prudential Supervision and Risk Management department, is notably in charge of (i) the prudential supervision of the more complex fund’s cases arising from the findings raised by the statutory auditors and the information provided by the supervised entities in the annual closing documents (e.g., annual reports, management letters, self-assessment questionnaires, and separate reports in line with the Circular CSSF 21/790) of the investment funds (UCITS, UCI, SIF, SICAR) as well as from the other available information (e.g., UCI reporting, notifications related to the Circular CSSF 24/856) and (ii) thematic reviews on key / relevant topics for the fund’s prudential supervision and the investment funds area.

As legal specialist, you will be involved in various and often more complex legal analyses of cases handled by the division as well as in the analyses related to regulatory matters or developments linked to the division’s activities. In particular, you will mainly be in charge of (i) analyzing the more complex findings and irregularities identified at the level of the funds and/or their investment fund managers/service providers (ii) the preparation of the required prudential supervisory measures including the related exchanges with the supervised entities and/or other stakeholders involved including, if any, other national or international competent authorities and (iii) providing support or advice on regulatory analyses linked to the division’s activities.

Role & responsibilities

  • Conduct comprehensive legal analyses and investigations of more complex findings or irregularities related to funds, their investment fund managers or any other service providers
  • Propose and prepare appropriate supervisory measures including draft analytical reports that address both technical and legal aspects and, if any, enforcement procedures
  • Work closely with team members and other CSSF departments
  • Interact with the responsible persons of the supervised investment funds, their investment fund managers and/or any other stakeholders such as other national or international competent authorities
  • Contribute to ad-hoc and thematic analyses on key / relevant topics for the fund’s prudential supervision and the investment funds area
  • Contribute to the ongoing development of the prudential supervision approach as well as related analytical tools and to maintain up-to-date knowledge of applicable regulations and legal developments in the funds sector

Your profile

  • Master’s degree in Law, preferably with a specialization in financial, corporate, or regulatory law
  • Additional legal qualifications (e.g., bar admission, LL.M., or certifications in compliance and regulatory affairs) will be considered as an asset
  • Professional experience of at least 5 years in the field of investment funds with a focus on legal analysis, compliance, regulatory affairs, or related roles. Experience in a legal department of an investment fund manager, respectively in a law firm or a legal department of a consulting firm in the field of investment funds is highly relevant
  • Solid knowledge of the regulatory framework (e.g., UCITS, AIFMD, CESR/ESMA)
  • Proficiency in written and spoken French and English. German and/or Luxemburgish will be considered as an advantage
  • Strong writing, analytical, structuring and synthesis skills, including the capacity to deal with (more) complex subjects/issues effectively and in depth as well as with a strong sense of thoroughness and precision
  • Proactive, rigorous, organised, communication skills and strong sense of discretion
  • Ability to work both autonomously and as part of a team

The successful candidate (m/f) will be hired as public employee (“employé de l’Etat”) under a permanent contract. If the candidate meets the required conditions, s/he will be asked to apply for admission to the status of civil servant (“fonctionnaire de l’Etat”).

Prior to the conclusion of the contract, the candidate must submit an extract from the criminal record (bulletin n°3), dated less than 2 months, in order to prove their conduct and integrity.
